Store Policies & Terms and Conditions

Welcome to OH! Paws & Petals! We are a small-scale, home-based grower dedicated to providing high-quality dahlias. By accessing our website or placing an order, you agree to the following Terms and Conditions and Store Policies.

OH! Paws & Petals: Terms & Conditions

1. General Agreement By purchasing from OH! Paws & Petals, the customer acknowledges and agrees to these Terms of Service. These policies are in place to set clear expectations and protect the biosecurity of our specialty flower farm. We reserve the right to update these terms at any time.

2. Ordering & Cart Policy

  • No Reservations: Adding items to your cart does not reserve them. An order is only confirmed once the checkout process is complete and you receive a confirmation email.

  • Quantity Limits: We grow in small batches; please respect all posted per-customer limits. Orders exceeding these limits or those suspected of using "bots" or automated systems may be canceled in full.

3. Order Finality & Cancellations

  • No Cancellations: All sales are final. We do not accept cancellations, changes, or modifications once an order is placed.

  • Combined Shipping: If you place multiple orders, use the code COMBINE at checkout to avoid duplicate shipping charges. We cannot retroactively refund shipping costs if the code is not used. We will attempt to combine orders for the same name/address whenever possible.

4. Shipping & Delivery

  • Timeline: Rooted Cuttings ship as per listing indicate.

  • Tuber shipping begins in mid-March (weather permitting).

  • Carrier Risk: Risk transfers to the customer once the package is handed to the carrier (UPS/USPS). We are not responsible for delays, losses, or damages caused by carriers or extreme weather events during transit.

  • PO Boxes: We recommend a physical address for UPS. If a PO Box is provided and requires a carrier change, the customer assumes all responsibility for resulting delays.

5. Live Arrival Guarantee & Claims We guarantee that your order will arrive in viable, healthy condition.

  • 24-Hour Notification: You must contact us via email (pawsandpetalsflowers@gmail.com) within 24 hours of the delivery timestamp to report damage.

  • Required Evidence: You must provide clear photos of the exterior packaging and the specific damage to the plants or tubers. Claims without photo evidence or submitted after 24 hours will not be accepted.

  • Resolution: Valid claims will be resolved via replacement (if available) or refund for the cost of the item, at our sole discretion. Shipping fees are non-refundable.

6. Tuber Specific Quality Guarantee Each dahlia tuber is guaranteed to:

  • Be true to variety (form/color).

  • Have at least one visible, viable "eye."

  • Be firm and healthy upon arrival.

  • Note: Minor variations in color or form can occur due to natural mutations ("sporting") or soil chemistry.

7. Cutting Specific Care Rooted cuttings are living, perishable tissue. They may show minor yellowing or wilting upon arrival due to transit stress. They must be unboxed, watered, and protected from direct sun immediately.

8. Virus & Health Policy

  • Sanitation: We maintain strict hygiene, disinfecting tools between every plant and culling suspicious stock immediately.

  • The Reality of Dahlias: Research (such as the ADS Genome Project) indicates that a high percentage of dahlias in cultivation carry latent viruses. No grower can guarantee 100% virus-free stock.

  • Assumption of Risk:

    • Strict Testing Window: If you suspect a virus, you must notify us and submit the plant to a certified diagnostic laboratory (e.g., Agdia, WSU, or a university plant clinic) within 3 days of the delivery date. * Proof of Submission:You must provide proof of the lab submission date. Because cuttings are highly susceptible to environmental infection once unboxed, we will not accept claims for tests submitted after this 3-day window.

    • Excluded Evidence: We do not accept visual "diagnoses" via photo, nor do we accept results from "at-home" test strips, as these are prone to user error.

9. Failure & Performance (Post-Arrival) Once a tuber or cutting is in your care, its success depends on your local environment. We do not provide refunds for:

  • Rot after planting or improper storage.

  • Pests, disease, or "ghosting" after the initial 3-day window.

  • Neglect, improper watering, or planting too early/late for your USDA zone.

  • Poor tuber production at the end of the season.

10. Substitutions If a variety becomes unavailable due to storage failure, we will contact you. We do not perform "surprise" substitutions. You will be offered a replacement of equal value, store credit, or a full refund for that item.

11. Returns & Restocking

  • No Returns: For the biosecurity of our farm, we do not accept returns of live plants or tubers.

  • Restocking Fee: In the rare event that a refund is issued outside of our standard policy (at our discretion), a 20% restocking fee will be deducted to cover administrative and processing costs.

12. Limitation of Liability OH! Paws & Petals is not liable for crop failure, lost growing seasons, or any indirect financial damages. Our maximum liability is strictly limited to the original purchase price of the product.

13. Right to Refuse Service

  • OH! Paws & Petals reserves the right to refuse service, cancel orders, or terminate accounts at our sole discretion. This includes, but is not limited to, suspected fraudulent activity, the use of automated purchasing systems ("bots"), violation of our terms, or instances of rude behavior toward our staff.
